Master planned commercial space comes with rules most tenants never read

Eastlake's shopping centers and office suites sit inside a planned community structure. Signage, hours, permitted use, and exterior changes are frequently governed by documents that are not your lease, and that most tenants never ask to see.

Eastlake

Business and real estate counsel for Eastlake

Eastlake is one of the largest master planned communities in the South Bay, and its commercial base reflects that: neighborhood retail centers, dental and medical practices, professional and financial services, fitness and personal service businesses, and a broad range of family owned operations serving a dense residential population.

The businesses here are exactly the kind that benefit most from getting the foundation right. First entity, first lease, first employee agreements, first partner. Those documents get written once and then govern for years, and most owners never revisit them until something forces the issue.

What I See Here

The issues that come up most in Eastlake

Commercial property in a master planned community carries a second layer of governance beyond the lease. Covenants, conditions, and restrictions recorded against the center, along with association or design review requirements, frequently control signage, exterior modifications, permitted uses, operating hours, and parking allocation. A tenant who negotiates a good lease and never reads the recorded restrictions can find that the thing they most needed to do with the space is not allowed. Neighborhood retail here also lives and dies on the tenant mix, which makes exclusive use provisions unusually valuable.

How It Works

Four steps, no mystery

The same process for every Eastlake client, with the scope and the cost settled before any work begins.

The free consultation

Describe the Eastlake matter in plain terms. There is no charge and no obligation, and you are speaking with the attorney rather than an intake screener. If you do not need a lawyer yet, I will say so.

Scope and cost agreed

Before work begins you get a clear description of what I will do and what it will cost. Defined work such as a formation or a document review is commonly handled on a flat fee.

The work gets done

Documents drafted, reviewed, redlined, negotiated, and filed, with plain language explanations of what each provision means for your business.

A relationship that continues

Most Eastlake clients come back for the next lease, the next hire, and eventually the exit. Knowing your history is what makes the second matter faster than the first.

Straight Answers

Eastlake questions I hear most

Ask Your Own Question

Why should I read the CC and Rs if I am only leasing?
Because they can restrict what you do with the space in ways your lease never mentions. Signage size and design, operating hours, exterior modifications, outdoor seating, deliveries, and permitted uses are all commonly governed by recorded restrictions or an association's design rules. Tenants discover this after they have signed and after they have committed to a build out.
What is an exclusive use clause and should I ask for one?
It prevents the landlord from leasing other space in the center to a directly competing business. In a neighborhood center where a limited customer base supports the tenants, it can be the single most valuable provision in your lease. Ask for it, define the protected use carefully so it actually covers what you do, and make sure it survives if the center changes ownership.
I am opening my first practice in Eastlake. Where should I start?
With the entity and the lease, in that order, and ideally before you sign anything. The entity affects your personal exposure and tax treatment. The lease determines your fixed cost, your flexibility, and whether the practice you are building can be sold later. Both are far cheaper to get right at the start than to fix once you are operating.
